Chapter 62
“You’re lucky too.” Bennie said then started transferring his files.
As soon as they all transferred to his new computer, I heard him cuss. “What’s wrong baby?”
“I think the old hard drive just died.”
I went over and tried to open the external hard drive and nothing happened. “I’m glad I decided to get you a whole new computer.”
Bennie hugged me tightly. “You’re a life saver baby.”
“What would you do without me?”
“I don’t know love but I wouldn’t be as happy as I am now.”
“I agree baby.” I said as I looked at the clock. “Dinner is about to be served, we better get in gear.”
We went into the bathroom and washed up then went out for dinner.
Ben was already at the table when we came in. “Dad, Ace got me a new computer.”
He looked over at me. “Oh did he now?”
Suddenly I thought I was in for it. “Yes Sir, I bought one that had been removed from service for repairs.”
Gloria brought dinner in and we made quick work of it. After we were done, she retuned pushing a cart. “I hope you left room for desert.”
She removed the cover and there were the fixings for strawberry shortcake. “Oh Gloria, you know my one weakness.”
“Señor Ace, you have a lot of weaknesses.” She replied as I turned red.
“It’s easy with all the good food you make.” I said as I fixed myself some of her decadent desert.
My plate was almost to overflowing with fresh homemade shortcake, strawberries and whipped cream. I saw Bennie stuff a forkful into his mouth then his eyes closed as he enjoyed the succulent taste. I quickly followed him and was rewarded with the sweetest berries I’d ever tasted. I ate everything on my plate then managed to go back for seconds. I shared some of my shortcake with Bennie. I took a forkful and went to feed it to Bennie. I was about to put it into his mouth when I saw Chris decide to play. He pushed the cake right into Bennie’s face. “Hay, this isn’t a wedding.” I said laughing at the whipped cream covering Bennie’s face.
“I was just practicing for when you and Bennie tie the knot.” Chris said laughing.
I stood up and took my napkin and cleaned my lover’s face. There was a small amount on his nose to leaned in and licked it off. Bennie took the fork and ate the offering I’d prepared for him.
He had some cream on his lips and I couldn’t resist the sight so I leaned in and kissed him. As soon as our lips touched, my cell phone rang. “Man baby, that was some kiss; I heard bells ringing.”
I had to laugh. “Those bells are from my cell phone.” I said as I reached into my pocked and took it out. “Mason.”
“Ace, we have a disaster.”
“A disaster?” I asked.
“Yes, some idiot released Lawson and the Babcocks.”
“Who the hell did that?”
“Some appeals judge named Desmond Morris.”
“Desmond Morris?” I replied. “Never heard of him.”
“He’s a new appointee to the bench.” Ben said answering my statement.
I covered my mouth piece. “Did you appoint him?” I asked.
“Yes I did.” Ben replied.
“Well, he sure stepped in it.” I said. “Adam, weren’t you notified of that hearing?”
“Hell no, that’s why I’m so angry. As the prosecutor, I have a right to be there. I’m calling the judicial review board and filing a formal complaint.”
“Adam, I have to get men over to the Matthews’s residence before they can try to kidnap the boys.”
“Alright Ace, keep me informed.” Adam replied.
“I will buddy.” I said then ended the call then called Dylan Masters. “Dylan, I need your team.”
“What’s up Ace?” He asked.
“I need you to get your men over to the Matthews’s residence.”
“I’ll recall them.” Dylan said.
“How many are here?” I asked.
“About half a dozen,” Dylan replied.
“Alright, get them and head over to Judge Matthews’s place.”
“What do you want us to do when we get there?”
“Get them all back to the residence.” I said as I saw Ben nodding his head.
“I’m on my way Ace.” Dylan said then ended the call.
I had one more call to make and this one I wasn’t looking forward to. “Matthews’s residence.”
“Carl, where is your Dad?” I asked.
“He and mom are watching the television.” Carl answered. “Dad, pick up, it’s Ace.”
“Hi Ace, I hope this is a social call. We haven’t seen you and Bennie in a while.”
“Well Cal, I wish it was.” I said seriously.
“This doesn’t sound good. Cal said.
“It’s not so please listen carefully,” I said. “I need you to pack some things for you and your family for several days.”
“Not again.” Cal said. “I hate running, who is at it now?”
“Maurice Lawson and the Babcocks,” I answered then headed to my room.
I put the call on speaker as I took my shirt off and put my vest
back on then redressed myself. “I thought they were in jail.”
“Yes Sir, they were until some judge released them on bond,” I said as I tucked
my shirt into my trousers.
“Shit,” Cal said. “Who are on their way here?”
“I have Dylan Masters and his team and I’m on my way. I’ll let you know when I’m outside.”
I ended the call then called the back gate to let them know I was on my way out. As soon as I hit the street, I turned my siren on. The traffic made a hole for me then I heard Dylan. “Ace, I’m right behind you.”
“Good, follow me.” I answered.
As soon as I made the turn onto Cal’s street, I shut the siren off. I saw Cal’s place then pulled into the driveway. I motioned to Dylan showing him where to park then knocked on the front door. The door slowly opened and there was Carl standing there. He let me in then I was mobbed by Timmy and Billy. “Are you boys ready to go?”
“Yeah we are Ace,” Carl said as I heard another knock.
I looked through the peep hole and saw Dylan and Francine. I let them in then they took everyone out and put them into the Hummer. “Get them to the residence and don’t stop for anyone.”
Francine nodded her head. “I’ll take them there personally Agent Mason.”
As soon as Cal and his family were safe, Francine took off. As soon as they were gone, Dylan’s team arrived. “The rest of my team is here Ace.”
“Good, have one agent hide outside so they can keep a lookout in case we get uninvited guests.”
“Got it,” Dylan replied.
He had his man hide then the rest of them came inside. “Alright men, here is the plan. We’re going to act like we’re the Matthews’s family spending a quiet night here at home.”
“Agent Mason, you don’t think someone would try and break into a Judge’s home, do you?”
“I wouldn’t put anything past these people. Maurice Lawson has made no bones that he wants Timmy and Billy by any means necessary.”
Dylan came over to me. “Do you want them alive?”
“I would prefer them alive but if they refuse to surrender, then take them any way you can.”
“You got it.” Dylan replied.
We settled down and I turned the television on and found a movie everyone agreed to watch. I looked at my watch and it was going on 10 PM. “Look alive guys, we have company. Someone is heading to the breaker box.”
“Thanks,” I replied. “Put your night vision goggles on.”
No sooner had I said that when the house went dark. The front door came crashing open and I saw Lawson carrying a weapon. “Check upstairs, I want those kids. If you have to kill them, I don’t care.”
We waited until everyone came in then Dylan’s team made their move. “Federal agents, drop your weapons.”
Lawson wanted to be Rambo. He aimed his weapon at Dylan and was given a gift for his trouble. Dylan fired one shot taking him out. There were two more people with them. When Lawson went down, they dropped their weapons. “Don’t shoot, we surrender.”
“Down on the floor face down,” I shouted.
I went over to them. “Lights coming back on,” I heard the agent outside say as I removed mine so I wouldn’t be blinded.
When the lights came back on, I saw who else was in the house. “Well, well, look who we have here,” I said as I put James Babcock in cuffs.”
Lawson was screaming his head off. “I’ve been shot, someone help me.”
I went over to him. “Shut up, if you hadn’t broken in here you wouldn’t have been shot.”
“Where are those fucking brats?” He screamed.
“They’re someplace you’ll not be able to find them.” I replied and put him in cuffs.
“Owwww, that hurts,” Lawson screamed.
“Suck it up, little girl,” I said to him.
“Medics are on the way,” Dylan said.
“I want four men with him at all times.”
“You got it,” Dylan replied.
I heard the ambulance pull up then two medics came in. Dylan pointed to Lawson. “Hey, I’m in pain here.”
“Get him some morphine,” The medic shouted.
“No,” Dylan said. “Let him wait until a doctor sees him.”
Two agents picked him up and plopped him onto the stretcher as he cried, “You’re all pricks.”
“And what do you think you are?” I asked. “Everyone heard you say you wanted the boys dead if necessary.”
“It’s the price of doing business,” Lawson shot back.
“Dylan, you better get back to the range, your shooting sucks man.”
“Yeah, I pulled the shot, I should have fired another.”
“Next time, don’t hesitate.” I said patting him on the back. “Get this slime out of here.”
The medics lifted the stretcher so they could extend the wheels then take Lawson out into the darkness. They hit a couple of bumps and Lawson screamed in pain. “Damn you idiots, I’ll sue you. Now get me something for this pain.”
“Stuff it asshole, you want to give out pain now you can feel what it’s like,” I said as he was wheeled to the ambulance.
They put him in the back then took off for the hospital. Once Lawson was gone, I went back inside to check on the Babcocks. “What have you got to say for yourselves?”
Rachel looked over at me. “I told you we want our grandsons and we’re going to get them one way or another.”
“That’s not going to happen. I’m going to find a dark sewer for you two where you’ll spend the rest of your lives,” I tossed back at her.
“Oh no you won’t,” James started. “We have friends in high places too.”
“Where you will be hidden away, they won’t know where to look until you’re nothing but a pile of rotting dust.” I answered getting sick to my stomach. “Get them out of here.”
“What do you want them charged with?” Dylan asked.
“Let’s see, we’ll go with breaking and entering, attempted kidnapping five counts and attempted murder five counts to go along with their current charges.”
One of the team led them over to his car and put them into the back seat. “I’ll meet you back upstairs. I have people to talk to.”
“Right Ace,” Dylan replied.
I got into my car then hurried back to the residence. As soon as I arrived, I quickly took the elevator to the residence. When I stepped off, I was surrounded by Timmy and Billy. “Why are we here Uncle Ace?” Billy asked as he jumped into my arms.
“Well, we haven’t seen you for a while so we thought you’d like to come for a visit.”
“Yippee,” Billy said as he kissed me on the cheek. “We get to have a sleepover.”
I was about to put him down when Tonka came over and started licking the little boy causing him to giggle. “Tonka behave,” I said and he sat. “Are you settled into your room?”
Timmy nodded his head. “Yeah, Bennie put us is in your room.”
“You liked my room, don’t you?”
“Yeah, especially when Tonka sleeps with us,” Timmy replied as he sat down and gave Tonka some attention.
Tonka rolled onto his back and licked Timmy’s arm as he got his tummy rubbed. Just then we’re joined by Chris. “Ace, you’re needed in the dining room.”
“Alright buddy, can you watch these two little ones? I asked.
“Sure,” Chris replied as I gave the boys a hug and kiss.
When I enter the dining room, Cal was visibly upset. “Ace, tell me you got them.” Ben asked.
“Yes Sir, one was wounded and the other two surrendered without incident.”
“Who was wounded?” Cal asked.
“Lawson tried to shoot one of Dylan’s men. Dylan told him to drop his weapon but he refused so Dylan had to shoot. He’s on his way to the hospital with two agents who will be with him until he’s released.”
“Ace, how did this happen?” Cal asked.
“Your Honor, we don’t know. Adam is totally ticked off because he wasn’t notified as he should have been.”
“That was totally illegal and can get him removed from the bench.”
“I think Adam is going to talk to the Judicial Review Board about this.”
“I want to know why he did this and put my family at risk,” Cal said.
“I understand that Cal. I too would like to know why he did this especially since the evidence was there that Lawson would try to kidnap the boys if he were released. That’s the reason Judge Stein denied him bond.”
“Judge Stein is one of the toughest but fairest men on the bench.”
“I know but he is a stickler for having things done correctly.”
“That he is but he knows when he issues a warrant, all the necessary evidence will be in order.”
I looked at the clock and it was almost 11. “Sir, it’s getting late and I have a feeling we’re going to have a big day tomorrow.”
“You’re right, I need to get the boys in bed.”
“They’re having fun with Tonka.” I said as I got up and went back to find the boys.
I didn’t see them so I went to my room. When I went inside, Chris was sitting on the corner tucking Timmy and Billy in. As soon as I stuck my head in, Billy saw me. “Give us a hug Uncle Ace.”
I went in and did my Uncle duties. “Sleep well boys, Tonka will be here with you both.
Just then I saw the covers move then Timmy started giggling. I put my hand on the moving lump then saw a dog’s head pop out. “Tonka wants to sleep with us.”
“So I see, don’t get used to that boy.” I said as I scratched his head.
Chris and I went out and I went into Bennie’s room. “What the heck is going on baby?”
“I don’t know love but we’ll get to the bottom of it one way or another.”
I got undressed and used the bathroom then got into bed for some much needed rest. I had just turned the light off when I heard a light tap on the door. “Come in.” Bennie said.
We were greeted by Carl and Jake. “What’s up guys, can’t you sleep?”
Jake came over and sat beside me then gave me a big hug. “No, we just wanted to see you before we went to sleep.”
Are you two guys alright?” I ask.
“We’re fine but why did we have to leave so fast?” Carl asked.
“I can’t go into all the details but it was for everyone’s safety.”
“Is someone after the little ones?” Carl asked.
“We don’t know but we’re not going to take any chances so we decided to bring everyone here so you are all safe.”
“Thanks Ace, we’ll let you get some sleep. See you in the morning.”
I got another round of hugs and kisses then Carl and Jake returned to their room. “What’s going on baby?”
“I don’t know everything but I do intend on finding out,” I said to my lover.
“Well, what do you know?” Bennie asks.
“I can’t go into it sweetie.”
“Aww, you’re not fair.”
“Come on now love,” I said. “You know I can’t tell you about an on-going investigation.”
“Alright,” Bennie relented then kissed me on the lips.
I rolled over and wrapped my arms around my lover as he snuggled against me.
I closed my eyes and went to sleep. The next morning I was awakened by Billy who was sitting on my lap. “Uncle Ace, Uncle Ace are you awake?”
I opened my eyes and immediately was hugged by the boy. “Yes son, I’m awake.”
“Come on, get up,” He said with a big smile on his face.
I look at the clock and it’s just after 7am. “Oh Billy, where is Timmy?”
“He’s still sleeping.” The boy replies.
“So how come you’re not?”
“I had to go pee and I couldn’t go back to sleep.”
I felt Bennie roll over then I saw a hand come out and pulled the little boy on top of him. “You need to let us sleep buddy.”
“I’m sorry Bennie.” Billy answered softly.
Bennie hugged him and then Billy reached his hands under Bennie’s arms and started to tickle him. “Billy, that tickles.” Bennie laughed. “Stop please, I have to pee.”
Billy kept at it until Bennie had to push the covers down and run to the bathroom. I heard water hitting water so I knew he made it in time. I got up and joined him then emptied my bladder. No sooner had Bennie finished doing his business when I was joined by Billy. “Can you give me a shower Uncle Ace?”
Bennie heard this and quickly started the shower. Once the water was right I stepped in followed by Bennie and Billy. Bennie grabbed the soap and started washing Billy which caused the little one to start giggling and squirming. “Ace how do you manage to wash him?”
I took over and Billy settled down as I cleaned him. I handed Billy the soap. “You can get your penis and butt.”
“Aww, alright.” He moaned.
Once Billy was clean he stepped out and started getting dried. “Make sure you’re completely dry buddy.” I said.
Bennie and I took our showers then stepped out to get dried and dressed. I remembered I needed a clean suit and that was in my room. I made sure I was quiet so I wouldn’t wake Timmy. I found a clean suit and was about to leave when I heard, “Morning Uncle Ace.”
I had my suit in front of me to hide my nakedness. “Morning tiger,” I answered.
“Why are you naked?” He asked.
I had to think fast. “Uh, I just got my shower and I forgot to bring some clean clothes over to Bennie’s room.
“Is Billy with you?”
“Yes he is and he had his shower too.”
“Darn, when can I get you to give me a shower?”
“Well, the first time you’re awake and I’m going to take one, you can join me.”
I saw the time so I told Timmy to get up and get his shower because it was almost time for breakfast. I went back to Bennie’s room and got dressed then went out to the dining room. When I entered, I saw Judy and Cal sitting at the table having their coffee. I fixed my first cup then joined them at the table. “Ace, are you free this morning?” Cal asked.
“I believe so but I’ll check with the President.” I replied.
Judy asked what was going on and I was about to answer when Bennie and Billy came in. Ben looked up when the boys entered. “After breakfast, we’ll have a meeting in my office.
I thought I was home free until he said. “Ace, I want you there too.”
Bennie looked up at me then to his Dad. All I could do was, “Yes Sir.”
Gloria came in with a huge platter of hot pancakes. The boys cheered as the adults started fixing their plates.
I swear, Timmy and Billy can eat faster than Bennie and Chris. I no sooner got Billy’s plate fixed when Timmy was asking for more. The one good thing was they did let Ben fix his plate before they went to town on the feast.
No sooner was the platter empty when Gloria returned with another one filled with hot fresh pancakes. The little ones had managed to stuff themselves so the rest of us got a chance to eat.
Once everyone had eaten, Ben stood then the adults followed him as we headed to his office off the living room. I was the last one in so I closed the door then took a seat. Ben looked at me. “Aright Ace, fill us in, please.”
“Yes Sir,” I started then sipped my coffee. “Yesterday in Judge Stein’s courtroom, Maurice Lawson, the Babcocks and Phillip Ware were to be arraigned.”
“What do you mean, were to be arraigned,” Ben asked.
“I’ll elaborate as I go,” I said answering him. “Lawson and the Babcocks had been arraigned and were denied bond.”
“On what grounds?” Cal asked.
“Well, we managed to get to Phillip Ware. He’d been hired by Lawson to find Timmy and Billy and to get them.
Judy gasped when she heard that but Cal patted her hand to calm her. “It seems neighbors saw him in the neighborhood and notified Metro PD.”
“So how did the Secret Service get involved?” Cal asked.
“When Lt. Brinkman from Metro PD arrived on the scene, he recognized several of the homes so he called me. I talked to Ware and told him to leave the area and not to return or face possible arrest. The next day he was back out there again and I was called.”
“Was he arrested at the time?” Cal asked.
“No,” I replied. “I decided to use him as an informant.”
“Ace that was very risky on your part,” Cal injected. “The defense could claim entrapment.”
“I’m aware of that and at no time did I ever entrap Lawson.” I answered handing him a written transcript of the CD.
Cal read it. “You were very lucky.”
“Not really Cal, I had Adam Graham with me so I did everything by the book. When I applied for the arrest warrant of Lawson, the Babcocks and Ware, it went before Judge Stein.”
“Didn’t that create a conflict of interest at the arraignment?”
“Evidently not Cal, Judge Stein didn’t recuse himself.” I answered.
“Alright Ace, please continue.” Cam said.
“Well, Lawson showed his butt several times and had to be sat on by Judge Stein. Lawson balked when bond was denied then he was shown his comments from the wire. I thought he was going to hurl on the spot but he just sunk down in his chair. When the Babcocks were brought in, they too were denied bond and Lawson showed his butt again causing him to receive yet another contempt citation and jail time.”
“So what happened with Phillip Ware?” Cal asked.
“When he was brought in, Adam asked if he could work out a plea agreement and once again Lawson showed his butt until Ware fired him.”
“Ware wasn’t represented by counsel?” Cal asked.
“No sir, Judge Stein asked him if he wanted one appointed for him and Ware declined saying he could handle this himself.”
I could see Cal mulling that over in his head. “Alright Ace, continue.”
“Well Adam worked out a deal with Ware where he will spend a year in jail, serve four years on supervised parole and will have to surrender his PI license. It was accepted by Judge Stein and that’s when Adam and I left the courthouse. Later that day, I was notified that Lawson and the Babcocks had been released by Judge Desmond Morris. I notified Adam and he went ballistic because he hadn’t been notified of the hearing Judge Morris held. Now to top it off, the three of them had been released ROR.”
I looked at Ben and he was about to blow a gasket. “With all the evidence, how the hell could that Judge let them out ROR?” Ben asked.
I shook my head. “I don’t know Sir; there was a mountain of evidence present that showed those three were a danger to society. Now what can be done so this guy doesn’t try to take this case and hear it?”
“He’s an Appeals Court Judge so that won’t happen.” Ben said. “But I’m far from happy at his antics.”
I looked at Cal. “Sir, did what he do constitute Obstruction of Justice?”
“It’s a stretch but if done right, you could get a conviction.” Cal answered.
“But who would want to take the case of an Appeals Court Judge?” Ben asked.
“I don’t know him personally but since I have a vested interest I would step aside.” Cal added.
“What about Judge Wheeler, he’s as unbiased as they come.”
“If he doesn’t have any conflict he could hear it if it comes down to it,” Cal answered. “What are you thinking, Ace?”
I broke out into a devilish smile. “Well, I don’t know if it’s kosher but I could make him an offer he couldn’t refuse.”
“Are you going Godfather on us now Ace?” Ben asked.
I had to laugh. “Who me Sir?” I replied putting on an innocent face. “If it made the job easier, why not? I wouldn’t do anything to break the law. I’d just make him an offer where he saves his bacon.”
“What are you thinking?” Cal asked.
“If he tendered his resignation from the bench effective immediately, he wouldn’t be arrested by me.”
Ben grinned. “I like your thinking but that wouldn’t stop the Justice Department from doing its own investigation.”
“Exactly boss.” I said as my cell rang. “Mason.”
“Ace, it’s Adam. I’m on my way over to the federal courthouse.”
“Go easy now buddy.” I said not wanting him to do anything rash that could get him into trouble.
“I’m not, that’s why I’d like you to join me.”
“Alright Adam, I’ll be on my way in a few minutes.” I replied then ended the call.
“Ace, don’t let Adam get into trouble.” Ben said.
“I won’t Sir.” I answered.
“Tell Judge Morris, he doesn’t want to be standing before me either.” Ben injected.
“I’ll pass on your words Sir.” I replied as I stood. “May I leave Sir?”
“Yes you may and tell Adam to keep his cool. I want to nominate him for the Attorney General and if he blows it I won’t be able to get him confirmed.”
I nodded my head then left the room so I could put my vest on and get Johnny up here to watch Bennie. I called down to Dusty and asked him if he could have Johnny come up. When I was ready, I went to the elevator and Johnny was about to step off. I didn’t need Tonka so I had Johnny keep him occupied. “I shouldn’t be gone long.”
“Does the President know you’re going out?”
“He does,” I replied then got into the elevator.
I got into my car and made the drive to the Federal courthouse. Adam was already there waiting on me so I parked next to him then we entered the building. “How are you going to handle this?” I asked.
“I’ve already talked to him this morning and he knows he messed up.” Adam said.
“So what does he plan on doing about it?” I asked.
“He didn’t say, so I guess we’ll find out when we get there.”
We found his courtroom then entered. The bailiff was at his desk and acknowledged us as we headed towards the front of the room. “May I help you gentlemen?”
I took my credentials out and Adam was holding his. “We’re here to see Judge Morris, he might be expecting us.”
The bailiff stuck his head into the Judge’s chambers then motioned for us to enter. My heart started to pound as I heard the door close. Judge Morris looked up and smiled. “I didn’t know the Secret Service was going to be here. Mr. Graham, as I said on the phone, I’m really ashamed of myself for my actions yesterday.”
“What were you thinking?” Adam asked.
The judge looked down as he shook his head then looked back at Adam. “I wasn’t counselor and I’m lucky no one was hurt other than a perpetrator.”
“You can thank Agent Mason for that.” Adam said trying to get a dig in.
“How did you know?” The judge asked.
“With all due respect Your Honor, it’s my job to know this.”
“Well, I’m glad you did. Can you please explain to me why those boys are at the center of this?”
“That’s easy, for the oldest reason known to man,” I said. “Money.”
“Please elaborate.” The Judge said.
“Those boys are the sole beneficiaries of their father’s SGLI Insurance policy.”
“I see,” Judge Morris said. “How much are we talking about?”
I had to think. “I believe it is over one million dollars.”
“That is a lot of money for children to handle themselves,” The judge said.
“Your Honor, their foster father would have a trustee appointed.”
“And who might that be?” The judge asked again.
“I’m sorry Your Honor, that is need to know.” I answered.
“Need to know Agent Mason?”
“Yes Your Honor, need to know.” I answered.
“And if I ordered you to tell me?” The judge tried to use his position.”
“I’m sorry Sir, this comes from the top. I’m not allowed to release that information.”
“I am a Federal Court Judge, Agent Mason.”
“I’m aware of that but this…”
“ENOUGH, now I’m ordering you to tell me.”
“Sir, I’ll not break a Presidential order and I recommend you stop trying to get me to.”
“I can hold you in contempt, Agent Mason.”
“I don’t recommend you do that.”
“I’ll not tell you again.” He said as I pulled out my cell phone.
“Mr. President, Judge Morris is threatening me if I don’t release the name of the boy’s foster father.”
I put the call on speaker so he could hear the President. “Did you inform him that I gave you an order not to release that information under any circumstances?”
“I did Sir but it didn’t seem to faze him.”
“Desmond, you don’t want to push this issue.”
“Mr. President, why are you protecting this information?”
“Since when does a member of the bench question my authority?”
“When it seems that you have over stepped your boundaries.”
“Excuse me?” Ben said extremely pissed. “Ace, return to the residence.”
“As you wish Sir.” I said then ended the call then headed for the door.
“Agent Mason, I haven’t dismissed you.”
“This meeting is over.” I said then opened the door and walked out.
“BAILIFF,” The Judge shouted.
I looked at him and shook my head and stepped out. “Ace, watch out.” I heard Adam yell.
I quickly drew my weapon as did the bailiff. “Don’t even think of it.”
“Bailiff, arrest that man.” The Judge hollered.
At that point I was in for a huge surprise. The barrel of an AR-15 came up and pointed at the Judge. “Ace, come with us please.”
“Just who the hell do you think you are?” Judge Morris shouted.
“Special Agent Dylan Masters, at your service but I’m here at the request of the President of the United States to escort Agent Mason and Mr. Graham.”
“You’ll not get out of this courthouse that I can assure you of.”
“I wouldn’t care to bet on that. My entire team is in the building and we’re prepared to escort and protect Agent Mason and Adam Graham outside to their vehicles. If you persist with this, I am prepared to arrest you for Obstruction of Justice.”
“Fine, get the hell out of here,” The judge shouted and went back inside his chambers.
Adam came out then we heard the door slammed shut. I’m glad I had my vest on and I was hoping I wasn’t going to need it because of some young trigger happy security guard. “Thanks Dylan,” I said patting his shoulder.
“Don’t thank me, the President sent us. He thought the judge might have acted like a total ass and he was right.”
Do you have your whole team here or was that a bluff?” I asked.
“I have the whole team, the others are outside.” Dylan answered. “We’re coming out guys.”
When we stepped into the hallway, we were met by two agents in black BDU’s. “What’s the situation like down stairs?”
“All secured Agent Mason. We have agents at the check in area.”
“I feel safe now,” I replied with a sigh.
“Now you know what the President feels like when he’s with your team.”
He was right. Never before had I had agents surround me like I was a dignitary. I went to reach for my weapon then Dylan tapped me. “You won’t be needing that. We have your back.”
We walked down the stairs and I could see CAT members checking people in to the courthouse. I then heard Dylan tell his men, “We’re on the ground floor, report to the front entrance.”
Just then, men started appearing out of nowhere.”
Adam and I were put in the middle of a circle of Counter Assault Team members then we stepped outside. We were almost to the first row of cars when we heard, “Stop right there Agent Mason, you’re under arrest.”
Just then the back window of a black Hummer opened and out slid the barrel of what looked like an M2 50 caliber machine gun. “Drop your weapon and raise your hands or you will be shot. This is your only warning.” A voice said.
The man must have seen the machine gun because he quickly stood up raising his hands. “DON’T SHOOT.”
“IS that what I think it is?” I asked.
“What do you think it is?”
It reminds me of an M2 50 caliber machine gun.”
“You’re good Ace.” Dylan replied.
“That’s from 20 years in the Air Force. That could totally remodel the façade.”
Dylan started laughing. “I know and I’d have hated to give the order to fire.”
“He wouldn’t have had a chance against that thing.” I said as we got to their Hummer.
“Where is your car?” Dylan asked.
“On the other side of yours here,” I answered.
“Mr. Graham, you’re to return to the residence with us Sir.” Dylan said.
“I have my own vehicle here.”
“Hand me your keys and one of my men will drive it. You have to sit inside the Hummer.”
Adam reached into his pocket and handed his keys to Dylan. “It’s the Mercedes, right there.”
Dylan handed a man the keys. “Drive that carefully.”
I got into my car then Adam stepped into the Hummer. Just then I saw another black Hummer appear and we got into a small convoy and returned to the residence.
On the way back, my heart finally slowed down to a normal rate. ‘It’s a good thing I took my medicine this morning or I might be having one hell of a migraine.’
We pulled onto the grounds and parked by the residence. When I got out I was glad I was home. We entered the West Wing and there was Tonka, Johnny, Bennie and Ben waiting for me. “I’ve never been so glad to see the CAT Sir.”
“I’m glad I sent them over. I never thought Desmond would have acted like a total jackass,” Ben said sadly.
“Sir, how can we get him off the bench?” I asked.
“After his stunt, I’m prepared to make him an offer he won’t be able to refuse.”
Just then, an aide came running out. “Mr. President, you need to see this.”
I could tell something was up because the young aide had a look of pure panic on his face. “Lead on son.” Ben said.
He went into our office and we watched a news bulletin from CNN. “We are covering a fast developing story out of Washington, DC. A Federal appeals court judge has apparently committed suicide.”
I quickly got a chair so Ben could sit down. He put his face into his hands and broke into tears. “This is all of my fault,” Ben cried.
“No Sir, it’s not.” I said as I put my arm around his shoulder.
“If I hadn’t have pushed him he’d still be alive.” Ben answered.
“Maybe sir but then again maybe not,” I countered.
“The name of the person has not been released pending identification then notification of the next of kin. Capital Police has the building secured along with the US Marshall’s service. We are learning that a Secret Service agent and an Assistant US Attorney were with the judge and they were escorted out by Counter Assault Team members from the Secret Service.”
“Holy shit, this isn’t going to bode will. The fucking press with have a field day with this.” I said then slapped my hand over my mouth as Ben was glaring at me.
“Ace, please keep your thoughts to yourself.” Ben said.
I knelt down and said. “My apologies Sir. That was most inappropriate.”
Just then my cell rang. I stepped out of the office so I could talk. “Mason.”
“Would you have to be the agent that was at the courthouse this morning?”
‘Oh shit, I’m in it now.’ I thought.
“I was there Ed but when we left he was very much alive. What do you know?”
“It seems the Judge blew his brains out,” Ed replied.
“Shit, I didn’t know he was carrying.”
“I guess he was. A lot of judges have concealed permits for their safety.”
“Who will get the body and do the autopsy?” I asked.
I’ve talked to the Marshall’s service and offered our assistance. I’ve sent Dr. Valez and Ms. Mayfield over to the courthouse to get the body and gather all the forensics necessary.”
“Dizzy is a good lab tech, you couldn’t have sent a better person Ed,” I replied.
“I don’t want you speaking to the press.”
“Don’t worry boss, I don’t plan on it,” I replied then ended the call.
‘Why was all this happening before my vacation?’ I thought. Today was Wednesday, tomorrow would be spent packing and controlling Bennie when he starts asking questions. I’ve been following the weather and it’s perfect so I’ll be packing lots of shorts.
I happened to see the clock and it was 11:30 so I have to get everyone up to the residence in time for lunch. Bennie came up to me. “Ace, I have to get Dad but he looks really upset.”
“Why don’t you get Chris and go back to the residence while I get your Dad.”
He gave me a big hug then took off. I returned to the office and saw that Ben was in better spirits. I made my way over to him. “Sir, it’s about time for lunch.”
“I’m not very hungry.” Ben said.
“I can imagine Sir but you have to eat something.”
“Alright Ace, I’ll try.” Ben said but I wasn’t encouraged.
While we were on our way to the residence, my cell rang. “Mason.”
“Agent Mason, there are two FBI agents here.”
“Who are they?” I asked.
I held on while the officer looked at their credentials. “One is an Agent Franco Harris and the other is someone named Herman West.”
“What do they want?” I asked.
I could hear a snotty agent in the background. “We’re here to talk to Special Agent Mason and we’re not taking no for an answer.”
I’d put the call on speaker. Ben took the phone from me. “Let me talk to that agent.”
The guard heard Ben’s voice. “Yes Sir.”
“Is this Mason?”
“Who is this?”
“Listen agent, we’re here to talk to you so we can do this two ways.”
Ben was doing a slow boil. “Agent, is this how you conduct business?”
“Listen to me, I’ll conduct my business any way I want to, you got it?”
“Unless you change that attitude, you’ll be cooling your heels exactly where you are.”
“You don’t get it do you. “We’re the FBI and as can go anywhere.”
“Is that so?” Ben replied. “You think you can just flash that badge and we’ll open the doors to the White House?”
“That’s exactly what will happen.”
Just then I heard a commotion in the background. Uniforms arrived and took control of the agents. “Mr. President, uniforms are here, what do you want them to do?”
“Send them on their way, I’ll talk to the director.”
“Yes Sir.” The officer replied then ended the call.
By now, we were in the residence. He picked up the house phone and called his office. He had Fred put in a call to the director of the FBI then transfer the call to the residence. I went down to Bennie’s room and there were six wet and naked boys in there. “Hey guys.”
Timmy almost jumped out of his skin. “Hey, don’t sneak up on a guy, Uncle Ace.”
I stepped inside and had to look alive because I had a little boy flying at me. I caught Billy as he wrapped his arms and legs around me. “We were swimming.”
I looked at Bennie then he picked up their suits off the floor. I smiled and nodded my head. “Has everyone had their shower?”
Billy was the first to answer. “Uh huh, we just got out. How come we can’t swim naked anymore?”
Bennie patted Billy’s pink bottom. “Ace caught some perv gawking at Chris and me one day.”
“What’s a perv?” Billy asked innocently.
“That’s someone who likes staring at people who are naked.”
“Ohoooooo,” Billy said. “That’s dirty.” Billy added and we all got a giggle at that then I helped Billy get dressed so we could get out for lunch.
Gloria was just bringing in the platters as we took our seats. “I hope everyone is hungry.” She said as she lifted the covers.
I saw a huge platter of spare ribs. Bennie and I got up and got napkins put on Timmy and Billy so maybe their clothes would survive the meal. Once that was done, Bennie and I fixed their plates then we attacked the ribs. The boys were little gentlemen but that couldn’t be said about Bennie. “Hey love, did you just come out of a battle?”
He looked at himself. “Hey, I love my food.”
“Yes you do and you wear it well.” I replied getting laughs from everyone at the table.
I was watching Ben and he was picking. “Dad, what’s wrong?” Bennie asked.
“Your Dad has a lot on his mind baby.” I answered kissing him on his sauce covered cheek.
Bennie finished his meal then went to his room and cleaned up. While he was gone, the phone rang so I answered it. “Residence, Agent Mason.”
“Ace, it’s Fred. I have the President’s call for him.”
“Sir, your call is here.” I said.
Ben got up. “I’ll call Fred and tell him where to transfer the call. Please come with me.”
“I heard Ace, I’ll wait for his call.” Fred said then I hung the phone up and went with Ben.
We went into his office then soon his phone rang. “Yes Mr. President, what may I do for you?” The FBI Director asked.
“Gene, you can tell me why two of your agents arrived here demanding they be allowed on the property to talk to Agent Mason. Now, I don’t take kindly to someone talking rudely.”
“Which Agent’s were there?”
Ben looked at me. “This is Agent Mason, the two agents here were Agent Franco Garcia. Now I happen to have worked with him before and he’s a first class agent. The other one was a Herman West and he was the rude one.”
“Thank you Agent Mason.” The director replied.
“Gene, what the hell is going on?”
“Well, we had an investigation on-going involving Judge Desmond Morris.”
“Why?” Ben asked.
“I can’t really go into it but we need to talk to Agent Mason.”
“Damn it Gene, I asked you a question now you better answer it.”
“Mr. President, it was an on-going investigation.”
“Gene, I’m not having a good day so if you value your job, you better start talking NOW!” Ben instructed.
“Alright, we were just about done when we hit a wall.”
“What was the problem?” Ben asked.
“There was one thing we needed but.”
I stepped in then. “But you couldn’t look at it.”
“Agent Mason, but out!” Gene shouted.
“Gene, don’t ever yell at him again or I’ll be asking for something. Are we clear on this?”
“Yes, Mr. President,” Gene said contritely. “Now to answer your statement, we didn’t have enough probable cause to look at his financials.”
“Without probable cause, you had a whole lot of nothing.” I said.
“Listen, you get over here.” Ben ordered.
“I don’t take orders from you.”
“I’ll charge you with obstruction.” Gene shouted.
“Based on what?” Ben asked.
“Because I can charge you.” The director said with a cocky tone.
“You really think so?” I tossed back.
“Yeah, I know so.”
“Good luck.” I fired back. “You don’t have enough to arrest a gnat.”
“We’ll see,” The director said. “I know judges who will give me whatever I want.”
“You really think so?” I asked.
“Yeah I do.”
“Well, no one orders Judge Stein.” I tossed back.
“What’s that supposed to mean?” The director asked.
“Judge Stein is doing warrants and he demands that everything be perfect or you won’t get it.”
“We’ll just see.” Gene
“Suit yourself.” I said.
“Gene, if you do this, it will cost you your job. Now, there are plenty of rooms here where you can talk to Agent Mason so I suggest you use one of them.” Ben said firmly.
“So you’re protecting him now, are you Mr. President.”
“Not at all but he has a job to do and you’ve not given me any reason why he needs to go to your office.”
“Because I demand it.”
“You don’t give me orders Gene,” Ben shouted.
“I’ll have an agent there to pick him up.”
“If you do, I’ll remove you from your position.”
“We’ll see.”
“Don’t push your luck.” Ben said.
“I’ll do my job as I see fit.”
“That’s it, I will expect your resignation within the hour otherwise you will be escorted from the building.”
“You don’t want to do this.”
“You give me no choice.” Ben said.
“I have agents who will do as they’re told.” Gene shouted then slammed the phone down.
Ben hung his phone up then went to work typing on his computer. “What are you doing?” I asked.
I’m writing an order removing him.” Ben answered.
“You want me to deliver this?” I asked.
“No chance,” Ben replied. “I’ll have Dusty and Dylan’s team.”
“Good idea,” I answered. “I don’t think those Agent’s will refuse a Presidential Order.”
“Anyone who does will be putting their career on the line.”
“Should I get Dusty for you?” I asked.
“Not yet Ace,” Ben answered.
“Alright, do you still need me?” I asked.
“Not now Ace, I was hoping Gene would have the decency to tell me what was going on but he tried to think he was above everything.”
I’d have loved to know what he was thinking but that wasn’t my call so I quietly exited the office. Since Franco was here today I thought I’d give him a call and see if he’d talk to me. “Franco, it’s Ace.”
“Hello my friend, how are you?”
“Confused Franco,” I answered. “Maybe you can help me.”
“I’ll do what I can,” Franco said.
“What is going on?”
“I’m not supposed to talk to you about this,” Franco answered.
“Come on buddy, your director is skating on thin ice with the President.”
“Oh no,” Franco said. “He’s ordered us not to answer any questions about this.”
“Why,” I asked. “What’s going on? He did let on that there was an investigation of Judge Morris but that’s all he’d say. He wouldn’t even talk to the President when he was asked directly by him.”
“How do you know this Ace?” Franco asked.
“I was with the President in his office when he was on the phone with your director.” I answered. “If you have questions, why haven’t you talked to the Judge’s bailiff?”
“I wanted to but the director flatly refused. He wants you for some reason. He got word from someone that you were the last one to see the Judge alive and now he’s dead.”
“So what?” He was very much alive when we left him.
“We?” Franco asked. “Who’s we?”
“Dylan Masters from the Counter Assault team, Adam Graham and myself. The bailiff was there too so he can attest the judge was alive when we left the courtroom.”
“I see,” Franco said. “You really need to talk to him.”
“Ace, what caliber weapon do you carry?” Franco asked.
“We’re carrying the Sig .357. Why?” I asked.
“The judge had a .45 at the time of his death.” Franco said.
“Who is doing the autopsy?” I asked.
“The body is with your Medical Examiner.”
“He’s one of the best as is our lab tech,” I added.
“I know that, that’s why you all are doing it.”
“If this was all he wanted, why the hell couldn’t he have talked to me here?”
“Like I said, he’s gunning for you for some reason. Personally, I think he has a thing against gays.”
“Oh for shit’s sake Franco.” I started.
“Ace, to me it’s not a big deal but there are some people who are living in the dark ages.”
I was getting the picture now. “Alright buddy, thanks for talking to me. Did I tell you everything you needed to know?”
“Ace, I didn’t need to know anything. I knew you weren’t involved in this but you did answer a lot of questions for me. Just so you know, I’ve recorded this and it will be a part of my report. I will be talking to the bailiff. This is something we should have already done.”
“Ok Franco, I want a copy of the recording.”
“Fair enough, I can get it to you tomorrow.”
“If you come here alone, we’ll let you in but if you’re with another agent and he gets mouthy, you might be turned away so please, you do the talking.”
“I’ll do that buddy. I’ll c’ya later,” Franco said then he ended the call.
I now had a lot more information than I did before. I went back to Ben’s office and knocked on the door. “Enter.”
When I went in, Ben and Cal were in a discussion. “I’m sorry Sir, I didn’t know you were busy, I can come back later.”
I stepped out and closed the door. I was almost out of the living room when, “Ace, please come here.”
I stopped and returned to the office. “Yes Sir?”
“Come in,” Ben said then returned to his desk then handed me a piece of paper. “Here is that letter you asked about for the cruise.”
“Thank you Sir.” I replied.
“Ace, do you know why the director of the FBI has you in his gun sights?” Cal asked.
“Yes I do now Cal,” I started. “I just had a nice chat with a friend of mine who is with the FBI.”
“And who is that?” Cal asked.
“Cal, I would like to keep his name out of this for right now. I don’t want the director to find out he talked to me then he gets jammed.”
“I understand Ace but he won’t learn of that information from me, so will you please tell me?”
I thought hard because Cal and I are friends and he’s never lied to me and I totally trust him. “Alright Cal, the agent is Franco Garcia. I worked with him on an operation that broke up a kidnapping ring.”
“Was that Wanita Jenkins?” Cal asked.
“That’s the case.” I said.
“So what did he tell you?” Cal asked.
“That the director of the FBI has me in his gun sights because I’m gay.”
Ben was livid. “Being a gay cop isn’t his problem.” Ben said then sat down at his desk and made a call.
Cal and I went over to the sofa and talked. “Ace, personally I’m really getting fed up with people wanting to challenge your fitness to be an agent based on your sexual orientation.”
“Just wait until Bennie and I tie the knot.” I added. “What are Jake’s and Carl’s plans for the future?”
“I really don’t know.” Cal started. “They’re looking towards college then getting established in the work force, I think. They haven’t let on if they plan on getting married or not but I think they just might. Do you and Bennie want to have children? I’ve seen you with the boys and they really love you and you sure do a good job with them.”
“I know I’d love to have a child but I’d have to see how Bennie feels about it. He plans on a career here with the Service so he might want to wait on trying to adopt.”
“You realize that might be a real problem.” Cal said. “A lot of states are trying to stop same sex couples from raising kids.”
“Based solely on the fact we’re gay? That’s a load of crap Cal.”
“You don’t have to sell me, I agree with you totally.”
“Well, if I’m denied just on my orientation and no other reason, they better be prepared for one hell of a fight because I’ll take it all the way to the Supreme Court if I have to.”
Cal was smiling. “That’s what it might take. There are same sex couples raising kids now and they’re doing a great job.”
“Coffee?” I asked as I got up to fix myself a cup.
Cal nodded his head and I fixed a cup for him too. I set our cups on the table as I heard a knock on the door. I was about to head over to open it when Ben shouted, “Enter.”
The door slowly opened and I saw Dusty’s head slip in. “Did you call for me, Mr. President?”
Ben motioned for Dusty to come in. “Agent Moore, I want you to take Agent Masters and his team with you over to the FBI Headquarters.”
“Yes Sir, and what is it you want me to do?”
“Deliver this to the Director and get his credentials and weapon.”
“Yes Sir,” Dusty said.
“Dusty, I don’t think he’s going to go peacefully but I don’t want him injured.”
“That will be totally up to him and his agents.” Dusty replied.
“Buddy, you’ll get the support of Agent Franco Garcia.” I said to Dusty.
“Why does that name sound familiar?”
“He was at the hospital when I was shot and ran point for the FBI when you and JR went to arrest Wanita Jenkins. I think you met him here when we were handling the case.”
I saw Dusty’s eyes roll. “That pain in th’ ass?”
“Chill out dude. He and I have become friends and he told me a lot that he didn’t have to.”
“Alright Ace, I will for you.”
“Get you team together now Agent Moore,” Ben said handing him a folded piece of paper.”
